In compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), the following information is provided regarding the processing of personal data submitted through this website.
Data Controller. The data controller varies depending on the purpose:
Data Protection Roles. When a guest books accommodation owned by Balsag Project SL (Sagrada Familia Flats building, property 10) or Cap a Puestu SL (Gaudí Flats building, property 11), those companies act as data controllers in respect of the guest's personal data. Balsells Zaragoza Gestio SL processes such data solely as a data processor, exclusively to provide marketing, booking management and guest services on behalf of the owner, pursuant to a data processing agreement entered into under Article 28 of the GDPR. Balsells does not use guest data for its own purposes other than those instructed by the controller, unless the guest gives separate consent (e.g. to receive commercial communications from BBarcelona Apartments).
Purposes. To manage the relationship arising from the booking and the provision of accommodation services; to handle enquiries and requests; and, subject to consent, to send commercial and informational communications.
Legal Basis. Processing is lawful on the basis of: (i) the performance of the booking contract or pre-contractual measures; (ii) compliance with legal obligations (including, among others, the registration and reporting of travellers); and (iii) the data subject's consent for the sending of commercial communications.
Retention. Data will be retained for the duration of the relationship and, thereafter, for the periods required by law to address potential liabilities (in particular, tax retention periods and those arising from traveller registration regulations). Data processed on the basis of consent will be retained until such consent is withdrawn.
Recipients. Data may be disclosed to the competent authorities where required by law, and to service providers acting as data processors (including, among others, the booking management system provider and payment gateways), with whom the relevant agreements have been executed. No international transfers of data are made except those covered by adequate safeguards in accordance with the GDPR.
Rights. Data subjects may exercise their rights of access, rectification, erasure, objection, restriction of processing, portability and not to be subject to automated individual decision-making, by writing to Balsells Zaragoza Gestio SL, Calle Cartagena, 243 - Ground Floor, 08025 Barcelona, or by email to info@bbarcelonaapartments.com, with the subject line "DATA PROTECTION". Where the controller is the accommodation owner, Balsells will forward the request to that controller. Data subjects have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
Accuracy of Data. The data subject is responsible for the truthfulness and accuracy of the data provided and undertakes to notify any changes.
